Course Details

The Personal Property Securities Act 2009 (Cth) (PPSA) is one of the most significant pieces of legislative reform for the Australian financial sector.

While the reforms have their greatest impact on financiers, the changes also impact on most businesses within Australia. It is vital for all practitioners to familiarise themselves with the PPS regime, due to its broad reaching scope and the complexity of the provisions in the PPSA.

This course provides an essential overview of the PPSA regime for practitioners. It examines the key features of the PPSA, including the breadth of the statutory definition of personal property security, the concept of security interest and new concepts such as attachment and perfection.  It discusses the object of the reforms and the changes taking place in corporate insolvency law and practice.

The course has been updated to include commentary on the end of the transition period on 30 January 2014, the recent 3-year review of the PPSA regime and the implications of the two most substantive decisions on the PPSA to date - Re Maiden Civil (P&E) Pty Ltd and Hastie Group Limited (No 3).
