Discovery is the most time and cost intensive pre-trial exercise.  Legal practitioners are spending increasing amounts of their time dealing with electronic documents as a part of the discovery process.  Consequently, it is essential for practitioners to understand their obligations in relation to e-discovery.

This course provides a practical overview of the e-discovery process, from developing an e-discovery proposal to presenting the evidence at trial.  It also discusses common sources of potentially discoverable electronic information, as well as how to collect, preserve, process, filter and analyse electronic evidence as part of the discovery process.

The course also discusses the relevant law relating to e-discovery, including: the court rules in each jurisdiction relating to e-discovery; the classification of electronically stored information as documents under the Uniform Evidence Acts; and recent relevant case law on the subject.
