Course Details

The focus of this course is the legislative provisions regulating unfair contract terms in standard form contracts. Until recently these provisions only applied to consumer contracts, but as from 12 November 2016 they now also apply to certain standard form contracts with small businesses.

This course provides an overview of the law in this area and explores the underlying rationale for the provisions. It examines contracts to which the law applies, which types of contracts and terms are exempt, and the text for unfairness in this context.

It also explores recent developments, including recent cases brought by the ACCC and the extension of the scope of these laws to cover small businesses.
