Course Details

The primary object of the Migration Act is to regulate the entry and presence of non-citizens in Australia, in a manner that aligns with Australia’s national interests. National security has always been at the core of the national interest.

This course explores some of the ways that national security considerations are relevant to migration law.  Some of these areas include:

  • national security considerations in citizenship applications;
  • offences which may indicate a person poses a national security risk;
  • the role of ASIO security assessments, including the scope for merits review.

The course also discusses recent amendments to the Citizenship Act which significantly expand the circumstances under which a person who holds dual nationality may forfeit their Australian citizenship.
