This course aims to equip lawyers to competently and confidently draft binding financial agreements that will stand the test of time.

Drafting BFAs has become increasingly stressful for lawyers. This is partly due to the complex requirements that need to be met for such agreements to be binding. Another factor is the increasing number of cases in which BFAs have been successfully set aside and, in some cases, the lawyers who drafted the BFAs being sued by the parties to recover their losses.

Despite this, BFAs remain an important tool for managing assets in the event of a separation, which means it is essential for lawyers to develop and maintain their knowledge and skills in drafting BFAs. This course aims to equip lawyers to competently and confidently draft BFAs. It provides:

  • an overview of the legislative requirements you must consider when drafting BFAs;
  • tips for advising clients on BFAs, including best practice record keeping;
  • useful drafting strategies that may be incorporated into your practice in order to continue to provide this vital service to your clients.

This course has been updated to reflect the changes to the legislation, rules and practice directions effected on 1 September 2021 when the Federal Circuit and Family Courts merged to form the Federal Circuit and Family Court of Australia. This update includes related changes made to the rules and practice directions for the Family Court of Western Australia.
