Lawyers are often asked to provide advice with respect to Directors’ and Officers’ liability insurance. This course provides an overview of the basic nature and distinctive characteristics of this type of insurance.
The course discusses some of the issues which most commonly arise in relation to Directors’ and Officers’ Liability insurance, such as non disclosure of claims and the circumstances which may give rise to claims, advance payment of defence costs and access by third parties to D&O policies.
The course also examines cases which outline recent developments in this area of law, including the decisions in ASIC v Healey (Centro Group), Hird v Chubb Insurance, Rushleigh Services v Forge Group (in liq) and CGU Insurance v Blakeley.
