Dr. James O'Donovan
Dr. James O’Donovan has practised in commercial litigation and banking and finance in most Australian jurisdictions and is currently Special Counsel at Lavan Legal.
Dr. O’Donovan is a Barrister and Solicitor of the Supreme Courts of Western Australia, Victoria and South Australia and a Solicitor of the Supreme Courts of Queensland and New South Wales. He has appeared in the Supreme Courts of New South Wales and Western Australia and the Full Court of the Federal Court and the Supreme Court of South Australia in some of the leading cases on corporate insolvency such as Powell v Fryer (insolvent trading), Sengate v Southern Equity Corporation and Re Stockbridge Ltd (schemes of arrangement) and Sheahan v Western United Ltd (constructive trusts and mutual set offs).
Dr. O’Donovan is the author of Lender Liability, and Company Receivers and Administrators and is the co-author of the Modern Contract of Guarantee. His most recent publication, Personal Property Securities Law in Australia, was published in May 2009.
Dr. O’Donovan is on the editorial board of the Insolvency Law Journal and the Companies and Securities Law Journal and is a regular contributor at state and national Insolvency Practitioners Association Conferences and Banking and Financial Services Law Association Conferences. He is also a Professor of Law at the University of Western Australia.
